One of Congress's most notoriously hawkish duos, Sen. John McCain [R, AZ] and Sen. Joseph Lieberman [I, CT], recently introduced legislation in response to President Obama's decision to try Umar Farouk Abdulmutallab, the Christmas Day airplane bomber, in a criminal court. Their proposal, which they are calling the Enemy Belligerent Interrogation, Detention and Prosecution Act, would empower the U.S. military to arrest anyone, U.S. citizen or otherwise, who is suspected of terrorist associations and detain them indefinitely, without right to a trial.
These are the folks who think the Constitution is just a 'g*d-damned piece of paper.'

Remember Ken Starr? The special prosecutor who spent millions of dollars of taxpayer money on a witch hunt into Bill Clinton's private sex life?
Well, now he's put all his weight and effort into defending the unconscionable Proposition 8 in California that would nullify some 18,000 marriages. He is trying to defend the constitutionality of a hate law, and it's time people spoke up about it. I can't even begin to understand how a person who claims to be defending family values would force 18,000 couples to divorce. It's like he's living in a bizzaro world of morality.
The Courage Campaign has put together a moving video full of personal photos submitted by gay couples and friends of gay couples asking simply not to be forcibly divorced. To me, issues like this are the hallmarks of whether we can call ourselves a civilized society.

My fellow citizens:
I stand here today humbled by the task before us, grateful for the trust you have bestowed, mindful of the sacrifices borne by our ancestors. I thank President Bush for his service to our nation, as well as the generosity and cooperation he has shown throughout this transition.
Forty-four Americans have now taken the presidential oath. The words have been spoken during rising tides of prosperity and the still waters of peace. Yet, every so often the oath is taken amidst gathering clouds and raging storms. At these moments, America has carried on not simply because of the skill or vision of those in high office, but because We the People have remained faithful to the ideals of our forbearers, and true to our founding documents.
So it has been. So it must be with this generation of Americans.
That we are in the midst of crisis is now well understood. Our nation is at war, against a far-reaching network of violence and hatred. Our economy is badly weakened, a consequence of greed and irresponsibility on the part of some, but also our collective failure to make hard choices and prepare the nation for a new age. Homes have been lost; jobs shed; businesses shuttered. Our health care is too costly; our schools fail too many; and each day brings further evidence that the ways we use energy strengthen our adversaries and threaten our planet.
These are the indicators of crisis, subject to data and statistics. Less measurable but no less profound is a sapping of confidence across our land - a nagging fear that America's decline is inevitable, and that the next generation must lower its sights.
Today I say to you that the challenges we face are real. They are serious and they are many. They will not be met easily or in a short span of time. But know this, America - they will be met.
On this day, we gather because we have chosen hope over fear, unity of purpose over conflict and discord.
On this day, we come to proclaim an end to the petty grievances and false promises, the recriminations and worn out dogmas, that for far too long have strangled our politics.
We remain a young nation, but in the words of Scripture, the time has come to set aside childish things. The time has come to reaffirm our enduring spirit; to choose our better history; to carry forward that precious gift, that noble idea, passed on from generation to generation: the God-given promise that all are equal, all are free, and all deserve a chance to pursue their full measure of happiness.
In reaffirming the greatness of our nation, we understand that greatness is never a given. It must be earned. Our journey has never been one of short-cuts or settling for less. It has not been the path for the faint-hearted - for those who prefer leisure over work, or seek only the pleasures of riches and fame. Rather, it has been the risk-takers, the doers, the makers of things - some celebrated but more often men and women obscure in their labor, who have carried us up the long, rugged path towards prosperity and freedom.
For us, they packed up their few worldly possessions and traveled across oceans in search of a new life.
For us, they toiled in sweatshops and settled the West; endured the lash of the whip and plowed the hard earth.
For us, they fought and died, in places like Concord and Gettysburg; Normandy and Khe Sahn.
Time and again these men and women struggled and sacrificed and worked till their hands were raw so that we might live a better life. They saw America as bigger than the sum of our individual ambitions; greater than all the differences of birth or wealth or faction.
This is the journey we continue today. We remain the most prosperous, powerful nation on Earth. Our workers are no less productive than when this crisis began. Our minds are no less inventive, our goods and services no less needed than they were last week or last month or last year. Our capacity remains undiminished. But our time of standing pat, of protecting narrow interests and putting off unpleasant decisions - that time has surely passed. Starting today, we must pick ourselves up, dust ourselves off, and begin again the work of remaking America.
For everywhere we look, there is work to be done. The state of the economy calls for action, bold and swift, and we will act - not only to create new jobs, but to lay a new foundation for growth. We will build the roads and bridges, the electric grids and digital lines that feed our commerce and bind us together. We will restore science to its rightful place, and wield technology's wonders to raise health care's quality and lower its cost. We will harness the sun and the winds and the soil to fuel our cars and run our factories. And we will transform our schools and colleges and universities to meet the demands of a new age. All this we can do. And all this we will do.
Now, there are some who question the scale of our ambitions - who suggest that our system cannot tolerate too many big plans. Their memories are short. For they have forgotten what this country has already done; what free men and women can achieve when imagination is joined to common purpose, and necessity to courage.
What the cynics fail to understand is that the ground has shifted beneath them - that the stale political arguments that have consumed us for so long no longer apply. The question we ask today is not whether our government is too big or too small, but whether it works - whether it helps families find jobs at a decent wage, care they can afford, a retirement that is dignified. Where the answer is yes, we intend to move forward. Where the answer is no, programs will end. And those of us who manage the public's dollars will be held to account - to spend wisely, reform bad habits, and do our business in the light of day - because only then can we restore the vital trust between a people and their government.
Nor is the question before us whether the market is a force for good or ill. Its power to generate wealth and expand freedom is unmatched, but this crisis has reminded us that without a watchful eye, the market can spin out of control - and that a nation cannot prosper long when it favors only the prosperous. The success of our economy has always depended not just on the size of our Gross Domestic Product, but on the reach of our prosperity; on our ability to extend opportunity to every willing heart - not out of charity, but because it is the surest route to our common good.
As for our common defense, we reject as false the choice between our safety and our ideals. Our Founding Fathers, faced with perils we can scarcely imagine, drafted a charter to assure the rule of law and the rights of man, a charter expanded by the blood of generations. Those ideals still light the world, and we will not give them up for expedience's sake. And so to all other peoples and governments who are watching today, from the grandest capitals to the small village where my father was born: know that America is a friend of each nation and every man, woman, and child who seeks a future of peace and dignity, and that we are ready to lead once more.
Recall that earlier generations faced down fascism and communism not just with missiles and tanks, but with sturdy alliances and enduring convictions. They understood that our power alone cannot protect us, nor does it entitle us to do as we please. Instead, they knew that our power grows through its prudent use; our security emanates from the justness of our cause, the force of our example, the tempering qualities of humility and restraint.
We are the keepers of this legacy. Guided by these principles once more, we can meet those new threats that demand even greater effort - even greater cooperation and understanding between nations. We will begin to responsibly leave Iraq to its people, and forge a hard-earned peace in Afghanistan. With old friends and former foes, we will work tirelessly to lessen the nuclear threat, and roll back the specter of a warming planet. We will not apologize for our way of life, nor will we waver in its defense, and for those who seek to advance their aims by inducing terror and slaughtering innocents, we say to you now that our spirit is stronger and cannot be broken; you cannot outlast us, and we will defeat you.
For we know that our patchwork heritage is a strength, not a weakness. We are a nation of Christians and Muslims, Jews and Hindus - and non-believers. Bush Quietly Seeks to Make War Powers Permanent
Pay careful attention folks! While everybody is busy watching the presidential races and Hurricane Gustav, your evil overlords are busy gutting the constitution.
As the nation focuses on Sen. John McCain's choice of running mate, President Bush has quietly moved to expand the reach of presidential power by ensuring that America remains in a state of permanent war.
Buried in a recent proposal by the Administration is a sentence that has received scant attention -- and was buried itself in the very newspaper that exposed it Saturday. It is an affirmation that the United States remains at war with al Qaeda, the Taliban and "associated organizations."
Part of a proposal for Guantanamo Bay legal detainees, the provision before Congress seeks to "acknowledge again and explicitly that this nation remains engaged in an armed conflict with Al Qaeda, the Taliban, and associated organizations, who have already proclaimed themselves at war with us and who are dedicated to the slaughter of Americans."
The New York Times' page 8 placement of the article in its Saturday edition seems to downplay its importance. Such a re-affirmation of war carries broad legal implications that could imperil Americans' civil liberties and the rights of foreign nationals for decades to come.
It was under the guise of war that President Bush claimed a legal mandate for his warrantless wiretapping program, giving the National Security Agency power to intercept calls Americans made abroad. More of this program has emerged in recent years, and it includes the surveillance of Americans' information and exchanges online.

Massive Police Raids on Suspected Protestors in Minneapolis
This is bad.
Commando squads are raiding houses occupied by journalists and peaceful protesters in Minneapolis for the RNC.
They seem to be targeting groups like I-Witness who documented the police abuses at the last RNC gather in New York four years ago. Those I-Witness videos were responsible for the dismissal of 400 cases where police officers had lied about the protestors. Without the video, those people would be in jail right now.
This is a MAJOR story and needs to get to the main stream media.
This is the face of fascism. So tell me, why do they hate America so much?
Protesters here in Minneapolis have been targeted by a series of highly intimidating, sweeping police raids across the city, involving teams of 25-30 officers in riot gear, with semi-automatic weapons drawn, entering homes of those suspected of planning protests, handcuffing and forcing them to lay on the floor, while law enforcement officers searched the homes, seizing computers, journals, and political pamphlets. Last night, members of the St. Paul police department and the Ramsey County sheriff's department handcuffed, photographed and detained dozens of people meeting at a public venue to plan a demonstration, charging them with no crime other than "fire code violations," and early this morning, the Sheriff's department sent teams of officers into at least four Minneapolis area homes where suspected protesters were staying.
Jane Hamsher and I were at two of those homes this morning -- one which had just been raided and one which was in the process of being raided. Each of the raided houses is known by neighbors as a "hippie house," where 5-10 college-aged individuals live in a communal setting, and everyone we spoke with said that there had never been any problems of any kind in those houses, that they were filled with "peaceful kids" who are politically active but entirely unthreatening and friendly. Posted below is the video of the scene, including various interviews, which convey a very clear sense of what is actually going on here.
In the house that had just been raided, those inside described how a team of roughly 25 officers had barged into their homes with masks and black swat gear, holding large semi-automatic rifles, and ordered them to lie on the floor, where they were handcuffed and ordered not to move. The officers refused to state why they were there and, until the very end, refused to show whether they had a search warrant. They were forced to remain on the floor for 45 minutes while the officers took away the laptops, computers, individual journals, and political materials kept in the house. One of the individuals renting the house, an 18-year-old woman, was extremely shaken as she and others described how the officers were deliberately making intimidating statements such as "Do you have Terminator ready?" as they lay on the floor in handcuffs. The 10 or so individuals in the house all said that though they found the experience very jarring, they still intended to protest against the GOP Convention, and several said that being subjected to raids of that sort made them more emboldened than ever to do so.

Death Watch on the 4th Amendment
Barring some miracle or act of god, the weak and ineffectual democratic led congress will vote to pass the awful FISA bill today, thereby eviscerating the 4th Amendment of the Constitution and giving President Bush dictatorial powers to spy without warrant on American citizens.
Congrats, jerks. You were able to undo our democracy in no time at all!
Seriously, this thing legalizes all the felonies committed at Dubya's behest over the last several years. It's a bonafide "get out of jail free" card if ever there was one.
Why the dems support this has been asked again and again, and the only thing I can guess is that some of them are implicated in the spying scheme. That is to say, they've known about it for some time and have kept mum despite knowing of its obvious illegality.
My outrage meter has been pegged at 11 for so long now, it's hard to muster the appropriate level of outrage that this absurd tyrannical move deserves.
But mark my words, today is the day that the 4th amendment begins its slow and painful death.
See you in the internment camps, I'll be the one over near the fence trying to figure out where we should dig the tunnels.

U.S. Accused of Holding Terror Suspects on Prison Ships
Yeesh, talk about extraordinary rendition. As if the black flights to pro-torture countries like Jordan and Egypt weren't bad enough, now we've got terror suspects being held on prison ships far from the supervision and oversight of the media, the Red Cross, Amnesty International, or ANY humanitarian or rights organization.
But remember kids, the United States does NOT torture. (I know this because a spoiled little frat-boy from Crawford Texas told me. So it MUST be true.)
The United States is operating "floating prisons" to house those arrested in its war on terror, according to human rights lawyers, who claim there has been an attempt to conceal the numbers and whereabouts of detainees.
Details of ships where detainees have been held and sites allegedly being used in countries across the world have been compiled as the debate over detention without trial intensifies on both sides of the Atlantic. The US government was yesterday urged to list the names and whereabouts of all those detained.
Information about the operation of prison ships has emerged through a number of sources, including statements from the US military, the Council of Europe and related parliamentary bodies, and the testimonies of prisoners.
The analysis, due to be published this year by the human rights organisation Reprieve, also claims there have been more than 200 new cases of rendition since 2006, when President George Bush declared that the practice had stopped.
It is the use of ships to detain prisoners, however, that is raising fresh concern and demands for inquiries in Britain and the US.
According to research carried out by Reprieve, the US may have used as many as 17 ships as "floating prisons" since 2001. Detainees are interrogated aboard the vessels and then rendered to other, often undisclosed, locations, it is claimed.

Tell Senator McCaskill to Vote NO on Cloture (FISA)
UPDATE: The cloture vote failed by a big margin. Good job flipping McCaskill. She voted against cloture and did the right thing.
I just got off the phone with Sen. McCaskill's office in Washington D.C. and she has yet to state how she will vote on the cloture motion pending on the awful intelligence committee version of the FISA bill.
The office assistant told me a) she isn't in the office yet, and b) she has not issued a statement on the bill since friday.

Be polite. Explain you are a constituent. Give them your zip code if they ask. And above all insist that she not support retroactive telcom immunity. If they did nothing wrong, they have nothing to worry about, right? Insist that she protect american citizens from illegal spying instead of protecting law-breaking companies from prosecution.
Also, remember that SBC/AT&T is a big player in Missouri politics and surely will be pressuring McCaskill to cover their asses. Remind her who she serves. (Us and not them.)
We must defeat any FISA bill that includes retroactive immunity. It's a blanket pardon for crimes done a the behest of the White House and it cannot be tolerated by a free people.

Claire McCaskill Votes to Kill Anti-Immunity FISA Amendment
I'm VERY disappointed in Claire. This is the second time she has voted the wrong way on telco immunity.
In a nutshell, the Senate was working on two versions of the FISA bill. One came from the judiciary committee and included NO provision for retroactive immunity and the other came from the intelligence committee and included immunity for the telcos. McCaskill helped kill the judiciary version. Nice going, Claire. You're doing Dick Cheney's work for him. Hope you're proud.
Yeah, I'm sure your corporate buddies at AT&T (aka SBC) are thrilled with you, but those of us who worked to get you elected are angered by your choices to take care of corporations instead of citizens.

The U.S. Senate is trying to rush through a bad FISA bill that includes immunity for telcos because they're in a hurry to catch their jets to Davos to hang out with rich people. Only Chris Dodd and a threatened filibuster stand in their way. Support Dodd and Russ Feingold on FISA. Call your Senators and demand they protect the constitution.

Student Tasered at Kerry Event
This may be a little upsetting to watch, but it's important to see how fascism is stealing across the face of our nation.
While this guy as a little excitable and high strung, nothing he did warranted the response he got from the police. And can somebody explain why Kerry just keeps blathering on while they are tasering this kid?
The Bush administration said Monday the constitutionality of its warrantless electronic eavesdropping program cannot be challenged.
The government is taking that position in seeking the dismissal of federal court lawsuits against the government and AT&T over its alleged involvement in the once-secret surveillance program adopted after the Sept. 11 terror attacks. The strategy was first recognized by the U.S. Supreme Court in a McCarthy-era lawsuit. It has been increasingly invoked in a bid to shield the government from legal scrutiny.
Two senior Justice Department officials, speaking on condition of anonymity in a teleconference with reporters, reiterated the administration's position that it was invoking the so-called "state secrets privilege" in arguing that the 9th U.S. Circuit Court of Appeals must dismiss the cases because they threaten to expose information authorities say is essential to the nation's security.
"The case cannot be litigated in light of the national security interest involved," one official said.
The officials spoke on the condition that their names would not be published because, they said, it was the government's protocol not to comment on pending litigation.
The Bush administration has invoked the state secrets defense often, from spy cases and patent disputes to employment discrimination litigation.
Still, two judges have ruled recently that the defense does not apply in two lawsuits challenging Bush's surveillance program. President Bush acknowledged in 2005 that the government was eavesdropping without warrants on communications in the United States as long as one of the parties to the communication was suspected of terrorism and outside the United States.
Can't even challenge their illegal activities in court! What has become of our republic? Oh, and remember that FISA revision they ram-rodded through congress last week? Yeah, that kinda lets the administration off the hook. Thanks, you weak-ass Dems, for rolling over like obedient lapdogs.

Bush Pushing for Even More Wiretapping Authority
Fresh from bullying the democrats into gutting FISA, Bush is already pushing for more authority.
This time, he wants to immunize the big telcos like AT&T from prosecution for helping him illegally spy on American phone calls and data. My outrage meter is pegged at infinity+1. Dunno how much more angry and frustrated I can get and still keep it all in perspective. We have become the very thing we claimed to fight against. The terrorists have already won because we have turned our own democracy into a dictatorship without them ever having to lift a finger. Nice going schmucks.
The only question I have left is if the gutless and nutless dems are going to do anything about it. (And don't hand me that happy crappy about how it's only for six months and then we'll do something different. That's what they told us about the so-called "Patriot" act.) Aaaaaaargh! The day after President George W. Bush marshaled political forces in Congress to grant him greater authority to engage in counterterrorism-related spying, the president stated that he would seek greater changes to the Foreign Intelligence Surveillance Act when the legislative branch returns to work in September.
"While I appreciate the leadership it took to pass this bill, we must remember that our work is not done," the President said in his Sunday statement. "This bill is a temporary, narrowly focused statute to deal with the most immediate shortcomings in the law."
The President said next month he would focus on further immunizing private companies that cooperate with government wiretapping. However, he used complicated language to describe these activities.
"When Congress returns in September the Intelligence committees and leaders in both parties will need to complete work on the comprehensive reforms requested by Director McConnell, including the important issue of providing meaningful liability protection to those who are alleged to have assisted our Nation following the attacks of September 11, 2001," he said.
Translated: AT&T needs to cover its ass in case one of those nasty EFF lawsuits manages to get past their defenses.

House and Senate Expand Bush's Wiretapping Powers (wait...WHAT?!)
This is disgusting.
Yep, the Dems caved and gutted FISA giving Bush a complete pass on domestic spying.
The US Senate Friday voted to extend the power of US intelligence agents to eavesdrop on terror suspects, in a victory for the White House after a tense showdown with congressional Democrats.
Democratic leaders balked at White House terms for a deal, but the Senate went ahead and passed a Republican bill which reflected President George W. Bush's requests.
The controversy centered on a program designed to listen in on telephone and email conversations mainly outside the United States, but routed through US-based communications firms.
Senators voted to permit intelligence officers to listen in to such conversations without obtaining prior approval from a special court.
The House of Representatives voted against a Democratic party alternative, but could vote on the version passed in the Senate, which provides rules which expire within six months, in the next few days.
"My Republican colleagues chose to rubberstamp a flawed administration proposal," said Democratic Senate Majority leader Harry Reid, accusing the White House of misusing anti-terror powers in the past.
But White House deputy spokesman Tony Fratto said the bill would give US spy agencies the tools they needed to fight terrorism.
"It is urgent that this legislation become law as quickly as possible, so we encourage the House of Representatives to swiftly consider and pass this bill."
Democrats were angry because they claimed the Republican approach would allow Attorney General Alberto Gonzales, target of their demands for perjury and impeachment proceedings, to authorize wide-ranging surveillance.
If they're so angry, then why in the blazes did they pass this turd?
